Terms & Conditions

Make a Wish (https://wishfountain.net) is run by me, through my company SMART CODING SRL, a company registered in Romania (CUI RO49279197, Reg. Com. ROONRC.J2023002373321), registered office at Mircea Alifanti 14, Cisnadie, Romania ("I", "me", "my"). By using this Service — including throwing a coin, submitting a wish, or making a purchase — you agree to these Terms & Conditions. If you don't agree, please don't use the Service.

What the Service is

Make a Wish lets you "throw a coin" into a virtual fountain: you choose a coin type (silver, bronze, or gold), pay for it, and submit a name and a short wish. Once your payment is confirmed, a coin of that type is assigned to you and displayed in the fountain on the site, together with the name and wish you provided. Bronze and gold coins may also carry an optional website link, and gold coins may carry an optional uploaded logo/avatar.

There's no account, login, or subscription — each purchase is a one-off transaction identified by the email address you provide at checkout.

Content you submit

The name, wish, link, and logo you submit are displayed publicly on the Service, visible to anyone who visits the site. Don't submit anything you don't want to be public. Once a coin is active, I intend to keep it displayed for as long as the Service operates — see "Availability" below for what that means in practice.

You agree not to submit content that:

I may, at my discretion, refuse, edit, or remove a wish, link, or logo that violates these rules, or deactivate the coin associated with it, without owing you a refund for doing so.

By uploading a logo, you confirm you have the right to use it and grant me a non-exclusive license to display it on the Service as part of your coin.

Pricing and payment

Prices are shown before you pay and depend on the coin type: silver is a flat price; bronze starts at a discounted "early-bird" price for a limited number of coins and then increases; gold has no fixed price — it increases with every gold coin already sold. Prices shown at checkout already include any applicable tax (VAT), calculated automatically based on your billing location where relevant.

Payments are processed entirely by Stripe. I never see or store your full card details — Stripe handles that directly. I do receive your billing address (required for correct tax calculation) and the amount charged, which I keep as part of my purchase and accounting records.

Refunds

Because a coin is assigned and displayed immediately once payment is confirmed, purchases are final and non-refundable, except in one case: if I'm unable to assign you a coin because that type has sold out at the exact moment of your payment, you're refunded automatically — no action is required on your part.

If something else goes wrong with your order, contact me at [email protected] and I'll do my best to sort it out.

Availability

I intend for your coin and wish to stay visible on the Service for as long as Make a Wish operates, but I don't guarantee permanent, uninterrupted availability. I may suspend, modify, or discontinue the Service (or any part of it), temporarily or permanently, at my discretion. I'm not liable for any loss you may feel as a result of the Service, or a specific coin, becoming unavailable.

Acceptable use

You agree not to:

Intellectual property

Everything on the Service other than the content you submit — the design, code, text, and branding of Make a Wish — belongs to me or my licensors and is protected by applicable intellectual property laws. You may not copy, modify, or redistribute it without my written permission.

No warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including — to the extent permitted by law — warranties of merchantability, fitness for a particular purpose, and non-infringement. I don't warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by applicable law, my total liability to you for anything arising out of or related to the Service is limited to the amount you actually paid for the coin giving rise to the claim. I'm not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits any liability that can't be limited under Romanian or EU consumer-protection law.

Third-party services

The Service relies on third-party providers to operate — see my Privacy Policy for details on Stripe (payments and tax), Brevo (transactional email), Google Analytics (site analytics), and Sentry (error monitoring). I'm not responsible for the availability or content of these third-party services beyond my use of them to run Make a Wish.

Governing law and disputes

These Terms are governed by the laws of Romania. If a dispute arises, please contact me first at [email protected] so we can try to resolve it informally. If we can't reach an agreement, the courts of Romania have jurisdiction, without prejudice to any mandatory consumer-protection rights you may have in your country of residence if you're an EU consumer.

Changes to these Terms

I may update these Terms from time to time. If I make a material change, I'll update the date below and, where appropriate, note it on the Service. Continuing to use the Service after a change means you accept the updated Terms.
